Important Timelines After a Work Injury
If you have been injured at work, quick action is important. You have 120 days after the day of your accident to notify your employer of the accident and your injury. Notice may include a written or verbal announcement of what happened, or it may be understood that your employer is notified if an ambulance was called. If you do not put your employer on notice within the 120-day limit, you may not be able to make a claim or collect workers' compensation at all.
You have three years from the day of your work accident to actually file your workers' compensation claim. When you contact me, I will go to work immediately to investigate the accident, talk with eyewitnesses, review medical reports, and gather evidence to support your claim.
The Workers' Compensation Process After a Work Injury
After an employee suffers a workplace injury, he or she must see a doctor approved by the employer's insurance company, called a panel physician. While most injured workers would prefer to see their own personal doctors, seeing an approved doctor is an important step of the process. After 90 days, if you still need medical care, you are free to be treated by your own doctor.
To build a strong workers' compensation claim, your doctor needs to provide a complete medical review about your injury and its connection to your accident at work. Depending on the severity of your injury and how long it affects you, I can secure medical proofs from medical specialists to substantiate your claim.
